1. INTRODUCTION

These Terms of Use ("Terms") govern your access to and use of the EnigmaGPT website, mobile applications, and services (collectively, the "Service"), operated by GOLDEN CLOUD APPS ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. ELIGIBILITY

The Service is not directed to children under 13 years of age. By using the Service, you represent and warrant that you are at least 13 years old. If you are under 18 years old, you represent that you have your parent or guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.

3. ACCOUNT REGISTRATION

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to disable your account at any time, including if we believe that you have violated any provision of these Terms.

4. ACCEPTABLE USE POLICY

You agree not to use the Service to:

Violate any applicable law, contract, intellectual property right, or other third-party right
Engage in any activity that is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable
Send unsolicited or unauthorized advertising or promotional materials
Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service
Use any robot, spider, crawler, scraper, or other automated means to access the Service (this restriction does not apply to public search engine crawlers operating in accordance with our robots.txt file)
Attempt to access areas of the Service that you are not authorized to access
Impersonate or misrepresent your affiliation with any person or entity
Attempt to upload viruses, worms, or other malicious software
Engage in excessive use of the Service that may negatively impact other users' experience
Create or use automated tools, bots, or scripts to solve puzzles or play games
Attempt to bypass, defraud, or manipulate our payment systems
Reverse engineer the game mechanics to circumvent normal gameplay

We reserve the right to monitor your use of the Service to ensure compliance with these Terms.

5. LICENSE AGREEMENT

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your personal, non-commercial use.

You may not:

Copy, modify, create derivative works, reverse engineer, decompile, or disassemble any portion of the Service
Remove any copyright, trademark, or other proprietary notices
Transfer, sell, license, or assign the Service or any materials accessed through the Service to any third party
Use the Service for commercial purposes without our prior written consent

All rights not expressly granted to you are reserved by us and our licensors.

6. INTELLECTUAL PROPERTY

The Service and its contents, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

The puzzles, riddles, scenarios, and other game content provided through the Service are our proprietary materials. You may not reproduce, distribute, or create derivative works based on this content without our explicit permission.

7. USER CONTENT

You may have the opportunity to submit content to the Service, including questions, feedback, and ratings ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Service.

You represent and warrant that: (i) you own or have the necessary rights to the User Content you submit and (ii) your User Content does not violate the rights of any third party or any applicable law.

We reserve the right to review, remove, or modify User Content at our sole discretion.

8. VIRTUAL CURRENCY AND PAYMENTS

8.1 Virtual Currency

The Service may include a virtual currency system ("Scarabs") that can be used to access certain features or content. Scarabs have no real-world value and cannot be exchanged for real money or items outside of the Service.

We reserve the right to manage, regulate, control, modify, or eliminate Scarabs at any time, including the right to change the value or availability of Scarabs. We shall have no liability to you or any third party for exercising these rights.

8.2 Purchases

All purchases made through the Service are final and non-refundable, except as required by applicable law or as explicitly stated in our Refund Policy below.

8.3 Payment Processing

Payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service and privacy policy. You represent and warrant that you have the legal right to use any payment method you provide.

9. REFUND AND CANCELLATION POLICY

9.1 Refund Eligibility

Refunds may be issued solely at our discretion, and typically only in the following circumstances:

Technical issues preventing proper use of purchased content
Unauthorized purchases (subject to verification)
As required by applicable law

9.2 Refund Process

To request a refund, contact us at support@enigmagpt.io within 14 days of the purchase date. Include your account information, the date of purchase, and the reason for your refund request.

9.3 Non-Refundable Items

The following are generally not eligible for refunds:

Scarabs that have been partially or fully used
Purchases made more than 14 days prior to the refund request

9.4 Processing Time

Approved refunds will be processed within 5-10 business days. The timing of when the refunded amount appears in your account depends on your payment method and financial institution.

10. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE OR OUR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (iii) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE IS LIMITED TO THE AMOUNT YOU HAVE PAID US TO USE THE SERVICE IN THE PAST 12 MONTHS OR $100, WHICHEVER IS GREATER.

12. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless our company, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

13. TERM AND TERMINATION

These Terms shall remain in full force and effect while you use the Service. We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13.1 Account Deletion

You may request deletion of your account at any time by contacting us at support@enigmagpt.io. Upon receiving your request, we will:

Deactivate your account within 30 days
Delete or anonymize your personal data in accordance with our Privacy Policy
Retain certain information as required by law or legitimate business purposes

Please note that:

Account deletion is permanent and cannot be reversed
You will not receive refunds for any virtual currency or purchases upon account deletion
Content you have shared publicly may remain accessible

14. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will provide notice through the Service or by other means. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.

15. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of Brazil, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Brazil-Canada Chamber of Commerce in São Paulo, Brazil. The arbitration shall be conducted in Portuguese or English at the user's choice, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

16. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

17. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and us regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.
